Kanye West Skit on SNL/Jena 6 Defendent Released/Ghita Fashion Show

After debuting at No. 1 last week, Kanye West's Def Jam album "Graduation" falls to No. 2 with 226,000, a sales slide of 76%. 50 Cent's "Curtis" does nearly the same, slipping 2-3 with 143,000 (-79%).

Chamillionaire's "Ultimate Victory" (Chamillitary/Universal Motown) debuts at No. 8 with 79,000 units, which is a charting best for the Houston rapper. His debut, 2005's "The Sound of Revenge," entered at No. 10 with 130,000.

Twista's fifth album, "Adrenaline Rush 2007" (Atlantic) enters at No. 10 with 41,000. That's a significant decline from 2005's "The Day After," which bowed at No. 2 with 129,000.

Mychal Bell of 'Jena 6' released on bail

(Source CNN) -- Mychal Bell, a black teenager accused of beating a white classmate and who was the last of the "Jena 6" behind bars, was released from custody Thursday after a juvenile court judge set his bail at $45,000.

Bell's release followed an announcement from LaSalle Parish District Attorney Reed Walters, who said he would not appeal a higher court's decision moving Bell's case to juvenile court.

Wearing a blue striped golf shirt and jeans, Bell walked out of the LaSalle Parish courthouse a week after an estimated 15,000-plus demonstrators marched through Jena -- a town of about 3,000 -- to protest local authorities' handling of the teens' case.

"We do not condone violence of any kind, but we ask that people be given a fair and even chance at the bar of justice," the Rev. Al Sharpton said outside the courthouse.

"Tonight, Mychal can go home, but Mychal is not out of the juvenile process. He goes home because a lot of people left their home and stood up for him," he said.

"Let America know -- we are not fighting for the right to fight in school. We're not fighting for the right for kids to beat each other. We're fighting to say that there must be one level of justice for everybody. And you cannot have adult attempted murder for some, and a fine for others, and call that equal protection under the law. Two wrongs don't make one civil right."

Demonstrators at last week's march were protesting how authorities handled the cases of Bell and five other teens accused of beating fellow student Justin Barker.

Many said they were angry that the students, dubbed the Jena 6, were being treated more harshly than three white students who hung nooses from an oak tree on Jena High School property.

The white students were suspended from school but did not face criminal charges. The protesters said they should have been charged with a hate crime.

Bell's attorney Lewis Scott said the teen was moved from jail to a juvenile facility earlier Thursday.

Walters said his decision not to appeal was based on what he believed was best for the victim in the case.

"While I believe that a review would have merit ... I believe it is in the best interest of the victim and his family not to delay this matter any further and move it to its conclusion," Walters told reporters. Video Watch the Rev. Al Sharpton discuss the teen's release »

He said last week's march, which included Sharpton and Martin Luther King III, did not influence his decision.

Bell, now 17, was the only one of the Jena 6 behind bars. His bond previously was set at $90,000.

A district judge earlier this month tossed out Bell's conviction for conspiracy to commit second-degree battery, saying the matter should have been handled in juvenile court. The 3rd Circuit Court of Appeal in Lake Charles, Louisiana, did the same with Bell's battery conviction in mid-September.

Prosecutors originally charged all six black students accused of being involved in beating Barker with second-degree attempted murder and conspiracy. Walters reduced charges against at least four of them -- Bell, Robert Bailey Jr., Carwin Jones and Theo Shaw -- to battery and conspiracy.

Bryant Purvis awaits arraignment. Charges against Jesse Ray Beard, who was 14 at the time of the alleged crime, are unavailable because he's a juvenile.

Wednesday, Gov. Kathleen Blanco announced that Louisiana State Police officers will protect the families of the Jena 6 and investigate any threats they have received. A white supremacist Web site posted the names and addresses of the six black teens after last week's march, calling on followers to "let them know justice is coming."

Thursday, the FBI said it had been made aware of allegations of threats.

"Threats are taken seriously, and as these investigations are ongoing we cannot comment further," said Sheila Thorne of the FBI's office in New Orleans, Louisiana.

The December 4 attack on Barker came after months of racial tension, including at least two instances of fighting in the town, sparked originally when three white teens hung the nooses.

Walters has said there was no direct link between the hanging of the nooses and the schoolyard attack, and defended the prosecutions ahead of last Thursday's peaceful march. Blanco defended the prosecutor Wednesday, saying, "He has a solid record and is highly respected among his peers."

Walters also addressed the stress and notoriety the town has been subjected to, saying the only way he and other residents "have been able to endure the trauma that has been thrust upon us is through the prayers of the Christian people who have sent them up in this community."

He also suggested that some kind of "disaster" was averted when thousands of marchers came to Jena last week.

"I firmly believe and am confident of the fact that had it not been for the direct intervention of the Lord Jesus Christ last Thursday, a disaster would have happened," Walters said.

"The Lord Jesus Christ put his influence on those people, and they responded accordingly," he said, without explaining exactly what he meant.

Soon after the district attorney spoke, a local reverend took issue with his comments.

"Obviously, we are serving two different gods here," the Rev. Donald Sidley said. "My Bible says that we should do -- we should be loving, love your neighbor as yourself.

"For him to try and separate the community like he is and then using Christ Jesus to influence the people that Jesus is working on their side, well, that's -- that's absurd. ... God is god of the human race," said Sidley, of the New Evergreen Church.

The public has spoken and with over 10 million votes received, Barry Bonds' 756th home run ball is heading to the National Baseball Hall of Fame, marked with an asterisk as a permanent footnote to the homerun record.

On September 15th, 2007, Marc Ecko bought Barry Bonds' 756th homerun ball at auction. For the next eight days, the country was encouraged to publicly debate the ball's fate by visiting www.vote756.com and choose to: (a) Bestow it intact to Cooperstown, (b) Permanently brand the ball with an asterisk before sending it to Cooperstown, or (c) launch it into space.

Mr. Ecko unveiled the results of the voting live on NBC's "Today" show, with 47 percent voting to add the asterisk; 34 percent to give it to the Hall of Fame intact; and 19 percent to send it into space. Combined, over 80 percent of voters believed the ball should go to Cooperstown, and over two- thirds felt that doubts surrounding the record needed to be recognized.

Commenting on the results, Mr. Ecko stated, "The fans have spoken and the asterisk will forever be part of the history of this ball. It is a reflection of fans' sentiments and will be preserved by the Hall of Fame in this manner. This was never about the record. I saw the purchase of the ball as an opportunity to open a national conversation using new media - the internet, blogs, videos - to allow America's oldest sport to have America's most modern conversation. The people should be the arbiters of what is historically significant about this artifact. The opportunities for expression, and our participation in the public square, are endless."

Last fall former composer Johnny Pate was sitting in his Southern California retirement community, mindlessly flipping channels, when something caught his ear. “I passed this award show with Jay-Z doing this big production with girls and all that, and I heard this tune. I was like ‘Whoa! I know that sound!’ ” Shortly afterward, Pate received a royalty statement and a five-figure check—Jay-Z’s producer, Just Blaze, had used portions of one of his songs for the hit single “Show Me What You Got.” “I’m still flabbergasted that they would sample something I wrote thirtysomething odd years ago,” says Pate.

Pate had unwittingly entered the burgeoning, byzantine world of sampling. Sampling—taking an artist’s music and using it to build a new tune—goes back at least to the Beatles and Pink Floyd, who used fragments of other songs. But modern-day sampling started in the South Bronx, where party DJs in the 1970s would find a favorite chunk of music and blend two duplicate records to play that section over and over. It has always been the de facto beat-creation process for hip-hop producers, but as the music has exploded in popularity, copyright laws have been enforced more regularly and the stakes—and money—involved in the sampling business have risen accordingly.

For example, as rapper Kanye West celebrates selling nearly 1 million copies of his new album, Graduation, last week, royalty checks aren’t just being readied for him, but also for Elton John, ’70s duo Steely Dan, and the abstract German band Can. West borrowed from a motley crew of musicians to create his hit album’s sound collage, which means he’ll be dividing his several million dollars with the original artists. Jay-Z, Nas, and even West’s competitor 50 Cent built their catalogs on sample-based albums, their tens of millions in royalties split among hundreds of artists, some of whom haven’t released a new song in decades.

Whenever music is sampled, the user has to get permission, or “clear” the sample with the original songwriters and, depending on the circumstances, the original performer and record label. Experts say artists can ask for a flat fee or a percentage of the new song’s publishing rights—anywhere from 15 to, believe it or not, 100 percent. (Publishing-rights percentages determine how much in royalties an artist gets from album sales.)

“Every single sample clearance is different,” says Kathleen Merrill, of the Parker Music Group, who has cleared music for sampling, TV, and movie use for 18 years. “And it’s really all over the place how long the process can take—there can be ten publishers on one song.”

It wasn’t this complicated in the ’70s and ’80s, when hip-hop was a subculture instead of a multi-billion-dollar business. While the law was more loosely interpreted before, now it is the creators’ responsibility to ask permission for every sound borrowed—from a bass line to a high hat—or, increasingly, be vulnerable to legal action.

“[Now] it is the song’s producer’s responsibility to notify the rap artist or the record company as to what they sample,” says Deborah Mannis-Gardner of DMG Clearances, a 15-year veteran of the business who has worked with Diddy, Nas, and Ghostface. It is now common to give album credit to the very important person who obtains the rights to samples.

This marks the biggest Soundscan debut by any album since Kanye's #1 Late Registration two years ago. GRADUATION -- which also entered the national charts at #1 in the U.K, Japan and Canada -- also establishes a new one-week digital sales record, where it logged over 132,000 album downloads, eclipsing Maroon 5's previous record of 102,000 earlier this year. The staggering Soundscan number also marks the biggest debut in Island Def Jam history.

A jury comprised of actor Josh Lucas (Poseidon), Australian born actress Rose Byrne (Damages, Troy), actor/director Griffin Dunne (The Accidental Husband, Fierce People, After Hours), Academy Award®-nominated director Bennett Miller (Capote), actress/director Mary Harron (American Psycho), director Tom McCarthy (Station Agent), and last year’s winner Matthew Bonifacio viewed the films alongside the audience and selected the winners for The Target Filmmaker Award, Second Prize, Third Prize, Best Actress, and Best Actor. 50 Cent Still Confident In Sales Battle With Kanye

After weeks of public rivalry between 50 Cent and Kanye West about whose Sept. 11 album release would sell more copies, West's "Graduation" (Def Jam) has pulled into a six-figure lead over 50's "Curtis" (G-Unit/Interscope), based on projections from representatives at the four major labels. That data indicates "Graduation" leads with 781,000 units, followed by "Curtis" with 603,000.

50 Cent had claimed he would retire from making solo albums if West won the sales battle, but in an interview with Billboard, he maintains the race is still early and there is no concrete winner just yet.

"[The sales] can't be considered [any one way] anyway because it's just a few days out," he says. "I guess [the music industry] would consider me to be a hip-hop favorite because of my sales history, and people like to root for the underdog."

50 Cent also changed his tune yesterday (Sept. 13) about his threat to stop rapping. On New York's Hot 97 radio station, 50 said if West outsells him he would instead go round for round, matching G-Unit releases with Def Jam's.

"The [fans that aren't supporting me now] are the same people that supported me in the past," says 50 Cent. "The impression I gave them was so strong that they have different standards for me. When my music comes out, if it was someone else's record, it would be a hit because it spun 3,500 times. But they're looking for the hottest music out at the time from 50 Cent, so if it's not that, then they show me resistance until I deliver. I've only been in the music business for four years and I'm already receiving some backlash. That's amazing, isn't it?"
